n: (ESA) an act that declares the intentions of Congress to conserve threatened and endangered species and the ecosystems on which those species depend. ESA provides for federal designation of species determined to be endangered or threatened. It prohibits the taking of an endangered or threatened species of fish, wildlife, or vegetation.

n: under ESA, killing, capturing, hunting, harassing, or modifying or destroying the habitat so that breeding, feeding, or sheltering of a species is significantly impaired. Consequently, clearing an area that is the actual or potential habitat of an endangered or threatened species could constitute a violation of the act.
